Terms of Service

The deal between you and Pinguingo, in plain English.

Note

This is a plain-English version of our terms, meant to be readable. It is not legal advice. If you operate Pinguingo, have a lawyer review this before you rely on it.

These terms are an agreement between you and [Registered owner name], a sole proprietorship (eenmanszaak) based in the Netherlands and registered with the Dutch Chamber of Commerce (KvK) under number [KvK number], which runs Pinguingo. By creating an account or using Pinguingo, you agree to these terms. If you do not agree, please do not use the service.

What Pinguingo is

Pinguingo helps you learn a language by dripping flashcards, prompts, and native audio to you on WhatsApp, so you can practise in the cracks of a busy week. We do our best to keep it useful and available, but we do not promise it will be perfect or uninterrupted.

Who can use it

You need to be at least 16 years old, or the minimum age for digital consent in your country, to use Pinguingo. If you are using it on behalf of someone else, such as a tutor setting things up for a student, you confirm you are allowed to do so.

Your account

  • Keep your login details to yourself and your account secure.
  • Give us accurate information, and keep it up to date.
  • You are responsible for what happens under your account, so tell us quickly if you think someone else has access.

WhatsApp and messaging

Pinguingo works by messaging you on WhatsApp. By giving us your number, you agree to receive learning messages from us there. WhatsApp is provided by Meta under its own terms, and we are not responsible for WhatsApp itself. You can stop the messages at any time by telling us, or by closing your account.

Tutors and students

Pinguingo has two roles. Students receive lessons and work through their own lists. Tutors teach, whether one-on-one or to a group, and can steer the vocabulary their students receive. If you are a tutor, you are responsible for having the right to teach your students and for how you use their progress data. If you are a student working with a tutor, you understand that your tutor can see the lists and progress tied to your lessons.

Acceptable use

Please do not:

  • Use Pinguingo for anything illegal or harmful.
  • Try to break, overload, scrape, or reverse-engineer the service.
  • Resell or copy Pinguingo without our written permission.
  • Upload content you do not have the right to use.

Payment and billing

  • Pinguingo offers a free trial. After it ends, continued use requires a paid subscription.
  • Subscriptions are billed in advance through our payment processor, Stripe, and renew automatically until you cancel.
  • You can cancel anytime. Your plan stays active until the end of the period you have already paid for, and we do not charge you again after that.
  • Because we offer a free trial, payments are generally non-refundable, except where the law requires otherwise. If something has gone wrong, email us and we will try to make it right.

Your content and ours

The word lists and replies you create stay yours. You give us permission to use them to run the service for you, such as scheduling your reviews and showing your tutor your progress. Everything that makes up Pinguingo itself, the software, branding, and content we provide, stays ours.

No guarantees, and our liability

Pinguingo is provided “as is”. We cannot guarantee that you will reach any particular level in a language, or that the service will always be available or error-free. To the extent the law allows, we are not liable for indirect or unexpected losses, and our total liability to you is limited to what you paid us in the 12 months before the issue arose. Nothing in these terms limits liability that cannot be limited under Dutch law.

Ending things

You can close your account at any time. We can suspend or end your access if you break these terms or use the service in a way that harms it or other people. If we do, we will tell you why where we reasonably can.

Changes to these terms

We may update these terms as Pinguingo changes. If we make a significant change, we will let you know. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Netherlands, and any dispute will be handled by the competent Dutch courts, unless mandatory consumer law gives you the right to a different forum.
